A Fountain Valley police officer twice begged a suspect not to shoot her after he took her gun as she and her partner attempted to talk with him in January, newly released body-worn camera footage shows.
Less than a minute later, another officer fired 10 rounds at the suspect as he got into the driver’s seat of a police SUV while still in possession of the firearm, killing him, the video, released by the department on Wednesday, May 14, shows.
The female officer’s body-worn camera shows the suspect, Osean McClintock, 26, had walked up to the driver’s door as she’s about to get out with her weapon drawn. McClintock grabs at the weapon while she’s still in the SUV and the two tussle until McClintock pulls it from her, causing her to tumble to the ground.
“You’re saved in Jesus’ name forever!” McClintock shouts during and after the scuffle.
“He has my gun! He has my gun!” she says. “Please don’t shoot me! Please don’t shoot me.”
McClintock backs up to behind the SUV, video shows. The officer runs for cover as her partner arrives. He tells McClintock multiple times to drop the weapon — but he does not.
McClintock walks to the driver’s side and gets in, with the gun, and is shot.
Warning: The following video includes violence and could be very disturbing to some.
Police wanted to talk with McClintock after receiving a call about 11 a.m. on Jan. 24, a Friday, that a man matching his description had tried to open a car door with a woman inside as she was parked at Kazuo Masuda Middle School, police said.
Officers found McClintock walking along Slater Avenue near Brookhurst Street and attempted to have him sit down on a curb.
“I don’t have to!” McClintock said and ran off while shouting, “In Jesus name I pray forever, amen!”
The male officer chases McClintock on foot, while his partner, the female officer, follows in the black-and-white SUV.
The officer on foot chases McClintock through parking lots, but can’t keep up as McClintock sprints away. He radios that if the suspect tries to run again, “Just let him go.”
The officer, over the radio, says that the suspect is wanted only for resisting arrest.
A minute later, the officer hears his partner screaming and continues to run toward El Corazon Avenue and San Mateo Street, ultimately finding the suspect with the gun.
She had stopped the patrol car, opened up the door and McClintock walked up to her, video shows. He started grabbing the gun as she was getting out of the SUV and beginning to get her handgun — leading to the confrontation.
Following the shooting, McClintock is seen briefly grabbing for the steering wheel before he falls to the right, the video shows. Police and paramedics pulled him from the SUV and attempted life-saving measures, but he died.
The Orange County District Attorney’s Office and Fountain Valley police are investigating the shooting.
